This document outlines the terms and conditions governing our working relationship with the CLIENT. All projects or services provided by JELGAVAS TIPOGRĀFIJA are subject to these terms and conditions.
1. Working/Billing Phases
Projects are divided into logical working phases, including material procurement. If the CLIENT cancels the project, the CLIENT will only be billed for the materials and the already completed stages of the production process. By initiating work, whether in writing (including fax, e-mail, WhatsApp or SMS messages, etc.) or verbally, the CLIENT agrees to these terms and conditions. The test prints requested by the CLIENT before the main print job will be treated as separate orders and therefore will be charged accordingly. Any corrections to the CLIENT’S print files or additional requests that are submitted after the production has begun and cause downtime will incur an additional charge.
2. Price Quotes
All quotations are based on written inquiries from the CLIENT. It is advisable for the CLIENT to carefully review and verify the quote before proceeding with any work. Upon accepting the price, both parties also agree on the terms and deadline for submitting the print files. Our quotes are valid for 15 days. Any changes requested by the CLIENT may impact the projects deadline and also may incur additional charges. If the CLIENT is not a VAT payer in its residence country or has not provided a tax payer’s registration number, JELGAVAS TIPOGRĀFIJA applies a 21% VAT in accordance with Latvian legislation.
If the CLIENT modifies any materials or technical specifications after confirming the order, JELGAVAS TIPOGRĀFIJA reserves the right to request a payment for already procured materials and to adjust the price accordingly based on the revised project specifications.
3. Submission of Print Files and Layout Fees
All price quotes are based on ready-for-print PDF files that meet JELGAVAS TIPOGRĀFIJA’s standards. The CLIENT must ensure that all submitted print files meet following requirements. If the quality of the submitted print files does not meet the printing standards of JELGAVAS TIPOGRĀFIJA, the CLIENT will be charged an additional fee for preparing the files for printing. JELGAVAS TIPOGRĀFIJA is not liable for image print quality, if this occurs as a result of low or insufficient resolution of the images provided by the CLIENT. The hourly rate for layout work is 30 EUR. In case of job’s cancellation, a payment will be charged for the entire time spent on the layout.
Print files are stored for 12 months after completion of the job, after which they may be discarded.
If the CLIENT fails to submit the print files upon the agreed deadline, both parties must agree on a new date for submitting the files and completing the order.
4. Revisions and Alterations
Any new work requested by the CLIENT and performed by JELGAVAS TIPOGRĀFIJA after the approval of the inquiry/quote is considered to be a revision or alteration. If, as a result of the alterations, the technical specification differs significantly from the original specification, JELGAVAS TIPOGRĀFIJA may submit a new price quote to the CLIENT for approval before continuing the work.
5. Lead time
The CLIENT should place orders at least two weeks before the file delivery. Most projects typically require 10 full business days to complete the print jobs, if all production materials and capacities are available. For large runs and specific projects additional production time is usually required. The lead time is calculated from the next business day after receiving a written confirmation/ approval of low-resolution print files from the CLIENT via email. JELGAVAS TIPOGRĀFIJA is not responsible for any delays in deadlines, if the CLIENT delays the approval of low-resolution files.
If the CLIENT requests a suspension of work for a period of 30 days or more, it will be required to make a full payment for acquired materials and performed jobs up to the point of PROJECT’S suspension.
6. Subcontracting
JELGAVAS TIPOGRĀFIJA has the right to subcontract unless otherwise specified by the CLIENT. JELGAVAS TIPOGRĀFIJA takes full responsibility for the quality of work of its subcontractors.
7. Over Delivery and Under Delivery
The CLIENT agrees to accept over delivery or under delivery that does not exceed 4% of the ordered print-run. JELGAVAS TIPOGRĀFIJA will issue an invoice for the quantities actually delivered. If the CLIENT requires a guaranteed quantity, the percentage of tolerance must be stated at the time of quotation.
8. Colour Proofs, Colour Matching and Print Quality
JELGAVAS TIPOGRĀFIJA cannot guarantee an exact match between the print production and the colour proof due to variations in paper, proof material quality, and potential colour changes during finishing processes such as lamination and varnishing.
If the CLIENT has not requested a colour proof, but has instead provided a previously printed copy of the book or its own colour proof as a reference for print production, JELGAVAS TIPOGRĀFIJA will make every effort to match the sample as closely as possible. However, it is important to note that exact colour matching cannot be guaranteed due to variations in technologies, changes in materials, or other factors.
The only acceptable and valid colour reference for printing is a colour proof that is printed on appropriate proof paper, whether coated or uncoated, and accurately represents a 1:1 scale of the intended printed result. Each colour proof should include the following information: Date of proof printing; File name of the printed proof; Applied printing standard; Ugra/Fogra Media wedge version 3; and Validation mark indicating the colour proof’s compliance with the chosen printing standard.
9. Errors and Omissions
The CLIENT is responsible for carefully reviewing proofs for accuracy, including spelling and technical illustrations. JELGAVAS TIPOGRĀFIJA is not liable for the CLIENT’S errors or omissions in the proofs.
10. Complaints
Any complaints must be submitted in writing within 10 business days of receiving the products. Claims made after this period will not be accepted.
11. Copyright Disclaimer
The CLIENT is responsible for ensuring that all materials supplied to JELGAVAS TIPOGRĀFIJA for reproduction comply with copyright, trademark, service mark, and patent infringement regulations. The CLIENT assumes all liabilities related to such materials. The CLIENT will indemnify and not hold JELGAVAS TIPOGRĀFIJA liable for any losses, expenses, or damages arising from the violation of copyright or trademark laws due to the illegal use of supplied images, photographs, slogans, trademarks, or graphical work.
12. Rights of Ownership
JELGAVAS TIPOGRĀFIJA reserves the right to photograph, distribute, or publish any work produced for the CLIENT for promotional and marketing purposes, including by indicating the CLIENT.
13. Rights to Refuse
JELGAVAS TIPOGRĀFIJA reserves the right to decline offering its services to the CLIENT in cases where the project’s content is pornographic, hateful, unethical, or contradicts the company’s core values.
14. Delivery and Shipping
The price quote includes delivery to a single address for a single shipment, unless stated otherwise. The delivery terms are DAP (Delivered at Place). If there are any changes to the delivery specifications, JELGAVAS TIPOGRĀFIJA will adjust the charges accordingly based on current rates. The CLIENT must provide the delivery address at least one week prior to the shipment. Failure to do so may result in JELGAVAS TIPOGRĀFIJA being unable to guarantee timely transport to meet the delivery deadline. If an urgent delivery is requested and agreed upon, all associated costs will be charged additionally.
15. Regulations for Storing Finished Goods
Upon receiving the finished goods, the CLIENT is responsible for storing them in suitable conditions. JELGAVAS TIPOGRĀFIJA cannot be held accountable for deformation of finished goods (paper and cardboard) if the CLIENT fails to comply with the specified acclimatization and storage conditions.
16. Property and Supplier’s Liability
If the CLIENT supplies its own materials, it is responsible for the quality and warranties of the materials and products. JELGAVAS TIPOGRĀFIJA reserves the right to refuse the service, if it has to use materials of poor quality. Additional materials must be provided to meet the requirements set for the print job.
JELGAVAS TIPOGRĀFIJA will charge the CLIENT for handling and storage of any paper or other raw materials provided by the CLIENT for the production of its work, subject to prior agreement.
17. Payment Terms
Unless agreed otherwise, a 100% prepayment is required (at least 50% before ordering the paper and other production materials and the remaining 50% before shipping the order to the CLIENT). In collaboration with the credit risk insurance company, a credit limit and a post-payment period of up to 30 days can be set for long-term cooperation partners based on their financial results (balance sheet, profit and loss statement).
Overdue payments are subject to an interest rate of 0.07% for each day of delay. If the non-payment results in disputes or litigation, the CLIENT agrees to cover all legal and collection fees incurred by JELGAVAS TIPOGRĀFIJA. JELGAVAS TIPOGRĀFIJA collaborates with a credit risk insurance company for debt recovery.
